DRAFT — NOT APPROVED FOR PUBLICATION
DRAFT — NOT APPROVED FOR PUBLICATION. This draft reflects the website's current functionality. Items marked [CONFIRM], [UNVERIFIED], or [REQUIRES APPROVAL] require Dr. Darlene Screen's confirmation before publication. We recommend review by a qualified Georgia attorney prior to publication. Nothing on this page is a final legal commitment.
1. Acceptance
By using https://theconfidentrose.org and its sub-platforms (The Global Power & Purpose Hub, Soul2Soul Podcast, Speaking & Bookings, Nonprofit Global Trailblazers, Books & Healing Resources, and the online shop), you agree to these Terms of Use. If you do not agree, please do not use the Site.
2. The Organization
The Site is published by The Confident Rose Outreach, led by Dr. Darlene Screen. Legal entity name, mailing address, and nonprofit tax status: [CONFIRM]. We do not represent the organization as IRS-approved or any donation as tax-deductible unless and until supporting documentation is confirmed.
3. Eligibility — Adults 18+
Website account registration and paid membership participation are intended for adults aged 18 and older. By creating an account you represent that you are at least 18. If we learn that an account was created on behalf of a minor without a verifiable parent/guardian relationship we may suspend or delete that account and refund any associated subscription charges prorated to the then-current period. Separate nonprofit community programs that may involve younger participants are governed by their own in-person consent processes and are not covered by these Terms.
4. Your Account
You are responsible for keeping your login credentials confidential and for activity under your account. If you suspect unauthorized use, change your password and contact us immediately. We may suspend or terminate accounts that violate these Terms, that are suspected of fraud, or that otherwise harm other members or the Site.
5. Memberships, Pricing & Automatic Renewal
Hub Memberships are offered in three tiers:
- Free Community — $0. No charge.
- Empowerment — $17 USD per month.
- Leadership & Legacy — $37 USD per month.
Automatic renewal. When you start a paid membership you authorize Stripe to charge your payment method the then-current monthly fee each month until you cancel. The subscription renews automatically at the end of each billing period.
Billing authorization. By completing checkout you authorize us (through Stripe) to store your payment method and charge the recurring fee shown at checkout. Taxes may apply depending on your location.
Payment failures & 7-day grace period. If a renewal payment fails, your paid-tier benefits remain active for a 7-day grace period while Stripe retries the charge and you have the opportunity to update your payment method. If the payment is not resolved within those 7 days, your account is moved to Free Community access; your learning history is preserved and paid-tier access is restored automatically if a later payment succeeds.
Cancellation. You may cancel at any time from your account page via the Stripe Customer Portal. Cancellation takes effect at the end of the current paid billing period; your access continues until that period ends, unless applicable law requires otherwise.
Plan changes. You may upgrade or downgrade between Empowerment and Leadership & Legacy through the Stripe Customer Portal. Stripe will show any prorated charge or credit before you confirm the change.
Payment processor. Stripe, Inc. is our payment processor. Your card details are collected and stored by Stripe under Stripe's own terms and privacy policy at stripe.com/legal/consumer and stripe.com/privacy.
6. Refund Policy — By Product Type
The paragraphs below are proposed terms for review. Each refund window, eligibility rule, exception, shipping requirement, and event cancellation clause is [REQUIRES APPROVAL] before publication. There is no blanket no-refund policy.
a. Monthly memberships (Empowerment, Leadership & Legacy). Members may cancel at any time; access continues through the end of the current paid billing period. Prorated refunds for the current period: [REQUIRES APPROVAL — e.g., prorated on request within N days of a failed renewal, or no mid-cycle refund as a default]. If a payment was processed in error or in the event of unauthorized charges, contact us promptly.
b. Physical merchandise. Proposed window and conditions: [REQUIRES APPROVAL — e.g., return accepted within 14 days of delivery for unused items in original condition; return shipping paid by the buyer; damaged-in-transit items replaced at our cost].
c. Workshops, classes & event registrations. Proposed window and conditions: [REQUIRES APPROVAL — e.g., full refund if cancelled by the attendee at least N days before the event; partial or credit-only within a shorter window; full refund if the event itself is cancelled by The Confident Rose Outreach].
d. Donations. Proposed terms: [REQUIRES APPROVAL — e.g., donations are generally non-refundable except in the case of a verified processing error; refund requests reviewed on a case-by-case basis]. We do not represent donations as tax-deductible unless supporting 501(c)(3) documentation is confirmed.
e. Any future direct book purchases. Direct Stripe book sales on this Site are currently gated and will not be enabled until shipping, inventory, fulfillment, and direct-sale pricing are approved. Refund terms for that eventual flow: [REQUIRES APPROVAL].
f. Amazon book purchases. Purchases made at Amazon via the external links on our Books & Healing Resources page are governed by the applicable Amazon checkout and seller terms, not by this Policy.
7. Speaking & Soul2Soul Podcast — Inquiries and Guest Interest
Submitting a speaking request or expressing interest in a podcast interview or sponsorship does not guarantee selection, booking, airing, or compensation. Scheduling, editorial, and sponsorship decisions remain at our sole discretion. If selected and participating, additional release language may be presented at that time.
8. Nonprofit Global Trailblazers Nominations
Submitting a nomination does not guarantee review, selection, or recognition. Nomination review, eligibility criteria, and recognition decisions follow their own processes and are made at our sole discretion. Information you share in a nomination may be reviewed internally and, if a nominee is recognized, limited information may be published with the nominee's or honoree's consent.
9. External Links
Our Books & Healing Resources page and other pages may link to external sites (including Amazon). We are not responsible for the content, products, services, pricing, or terms of external sites.
10. Intellectual Property
All content, branding, logos, photography, writing, and course materials on the Site belong to The Confident Rose Outreach or their respective rights holders. You may not copy, redistribute, publicly display, modify, or create derivative works without prior written permission, except for personal, non-commercial fair use.
11. User Submissions & Conduct
If you submit a message, nomination, review, or any other content, you grant us a non-exclusive, royalty-free license to use that submission for the purpose it was provided (e.g., responding to your inquiry, reviewing a nomination, publishing a selected quote with your consent). You agree not to submit unlawful, harassing, infringing, or deceptive content, and not to attempt to disrupt, probe, or gain unauthorized access to the Site.
12. Disclaimers
Site content is provided for informational, educational, and inspirational purposes. Nothing on the Site is a substitute for professional medical, legal, financial, mental-health, or spiritual counsel. The Site and its content are provided "as is" and "as available" without warranties of any kind to the fullest extent permitted by law.
13. Limitation of Liability
To the fullest extent permitted by applicable law, The Confident Rose Outreach, its officers, directors, employees, volunteers, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Our aggregate liability for any claim arising out of or relating to these Terms or the Site will not exceed the amount you paid us in the 12 months preceding the claim. [REQUIRES APPROVAL — this cap and any carve-outs required by applicable law.]
14. Dispute Resolution & Governing Law
We prefer to resolve concerns informally first. If you have a dispute, please contact us at hello@theconfidentrose.org [UNVERIFIED] and we will make a good-faith effort to work with you promptly.
If a dispute cannot be resolved informally, it will be governed by the laws of the State of Georgia, United States [CONFIRM — governing jurisdiction subject to verification], without regard to its conflict-of-law rules. Both parties consent to the exclusive jurisdiction of the state and federal courts located in [CONFIRM county, Georgia], subject to any mandatory consumer-protection law of your home jurisdiction.
These Terms do not contain mandatory binding arbitration, class-action waiver, or jury-trial waiver. [REQUIRES APPROVAL — any such clause would require separate, explicit approval before publication.]
15. Changes to These Terms
We may update these Terms. Material changes will be flagged on the Site; continued use after an update means you accept the updated Terms. The effective date of the final published version will be shown here once approved.
16. Severability & Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of the Site.
17. Contact
Questions about these Terms: hello@theconfidentrose.org [UNVERIFIED] or mailing address [CONFIRM].
